The Central Government has released a new draft of changes in IT Regulations- 2021. With this, social media platforms will not be able to ignore government instructions. They will have to follow instructions, guidelines and advisories. If they do not do so, the digital media companies concerned will be held directly responsible.
With this, the legal shield provided to these companies under Safe Harbor will be removed. The most important change in IT rules is that the platforms themselves will be responsible for every content posted by their users. At present, till April 14, the government has sought public suggestions and objections on this draft.
Will not be able to delete data
- According to the new rules, if it is necessary to keep the data safe under any other law, then the platforms will not be able to delete it. Matters related to finance, tax or investigation will have to be kept safe.
- Currently, the Digital Media Ethics Code was applicable only to news publishers, but users posting news or current affairs on social media will also be within its scope.
- The government can send any content related matter directly to the review committee. For this it will not be necessary to wait for someone’s complaint.
Understand ‘Safe Harbor’ in simple language like this
Legal Shield: This is a security cover given to social media companies, which says that if a user has put any wrong post or video on the platform, then the company will not be held responsible for it.
Conditional Security: This protection is available only as long as the companies follow the government rules. If they do not remove the SGI within 3 hours of receiving the complaint, then this security cover ends and the police can also file a case against the company.
Internet Freedom Foundation said- Government is imposing censorship
Protest against changes in IT rules has started. Internet Freedom Foundation has alleged that the government wants to impose censorship on online content. Its purpose is to curb the content that taunts the government, makes fun of it and copies it. The government is trying to crack down on common users by attacking the safe harbor.
