Chakkarpur land parcel under spotlight as SC seeks replies on contempt plea

Gurgaon: Supreme Court has issued notice in a contempt petition filed by Rajdarbar Iconic Venture in connection with its Dec 17, 2024 judgment on unauthorized constructions, drawing attention to a land parcel in Chakkarpur village.Hearing a contempt petition on April 17, a bench of justices JB Pardiwala and Vijay Bishnoi condoned delay in filing the petition and directed respondents, including Anurag Rastogi and others, to submit their replies by May 7, 2026. The court also dispensed with their personal appearance at this stage.The petition names several respondents, including senior Haryana officials such as chief secretary, officers of the town and country planning department, HSVP, MCG, Dakshin Haryana Bijli Vitran Nigam and private individuals.The contempt plea arises from Supreme Court’s earlier ruling in 2024, which laid down a framework for regulating building construction and ensuring compliance with sanctioned plans. The judgment stated that completion or occupation certificates must be obtained before essential civic services, including electricity, water supply, and sewerage connections, are provided. It also held that permission for commercial activities should not be granted in buildings that do not conform to approved plans.In the current petition, the company has referred to a 1.39-acre land parcel in the revenue estate of village Chakkarpur in Gurgaon. It stated that, after the Dec 2024 judgment, it submitted representations to the authorities seeking action in accordance with the court’s directions.According to the petition, these communications were sent between Dec 2024 and Janu 2025 and sought implementation of the framework laid down by the court. It further stated that notices were issued to the authorities concerned for enforcement of the directions contained in the judgment, but no response was received.The matter is now before SC in its contempt jurisdiction, with the court seeking responses from the respondents. The case will be taken up further after the replies are filed.The proceedings assume significance in the context of enforcing judicial directions on building regulations and planned urban development, particularly in rapidly expanding urban regions such as Gurgaon.
